Terms
The terms behind the prices.
The pricing page says most of this already. These terms put it in one place so everyone knows what they're agreeing to before any money changes hands. Every client also gets a written plan that spells out the specifics of their project.

Using this website
digitalwaymark.com is published by Digital Waymark of Valdosta, Georgia. You're welcome to browse it, read it, and contact us through it. The design, text, images, and code are ours or used with permission, and you agree not to copy them, scrape the site, or use it to send us spam or anything unlawful.
The site is provided as is. We work to keep it accurate and available, but we don't promise it will always be either, and we aren't liable for losses that come from relying on it or from it being unavailable.
Published prices
The prices on this site are real and current as of the date on the pricing page, and they're for a normal local business: a single location, a modest number of pages or products, and content that's ready or close to it. Larger, more complex, or unusual work costs more, and we tell you the number in writing before you decide anything.
A published price isn't a contract by itself. The work begins when you've approved a written plan that states the scope, the price, and the schedule. If the plan and this page ever disagree, the plan wins. We can change published prices at any time, but a price in your approved plan doesn't change for the term of that plan.
Anything not listed in your plan is extra. We won't add work or charges to your bill without your approval first.
Getting started
The getting-started fee covers a conversation about the business, gathering your content, and a written plan with a price and a date. It's due before that work begins, it's credited to your first month if you go ahead with us, and it isn't refunded if you don't.
Monthly plans
Monthly plans are billed in advance each month, starting when your plan is approved, and paid by card or bank draft on file. Website subscriptions have a 12-month initial term, then continue month to month. Get found has a three-month initial term, then continues month to month. Either can be cancelled after its initial term with 30 days' written notice.
A website subscription includes the design and build, hosting, security updates, backups, an hour of changes each month, and a redesign every four years while you stay on the plan. Unused change time doesn't roll over. Text, photo, hours, and price updates are changes; new pages, new features, integrations, or a different design are quoted separately.
If a payment fails and isn't fixed within 15 days of our notice, we may pause the site, the search work, or both until the account is current. If it stays unpaid for 30 days, we may treat the plan as cancelled.
Ownership
Your domain name, your logo, your photos, your writing, and anything else you give us are yours from day one, and we'll hand them back whenever you ask. Accounts we set up in your name, such as Google, Shopify, or HubSpot, are yours too.
The website we build under a monthly plan, meaning its design, code, and structure, stays ours while you subscribe. After 12 months you can buy it outright at the buyout price published on the pricing page at the time your plan was approved, and then it's yours completely. If you cancel without buying it, we take the site down after the notice period and return your domain and content. A website built outright is yours once it's paid in full.
We may reuse general techniques, tools, and code we've built for many clients, and we may show your finished work in our portfolio unless you ask us not to.
One-time and quoted work
One-time work such as strategy, branding, photography, custom development, or a site built outright is scheduled once a deposit is paid, with the balance due at completion unless the plan says otherwise. The plan includes a set number of revision rounds; more are billed hourly. If a project stalls on your side for more than 60 days, we may close it and bill for the work done.
Third-party costs
Advertising spend goes directly to Google, Meta, or the platform running the ads. Shopify plans and payment processing, HubSpot tiers above the free level, domain registration, premium software, stock photos and fonts, and AI platform usage are paid to those companies and aren't included in our prices unless a plan says so. We'll tell you what to expect before anything is set up.
Results
Search engines, AI answer engines, map listings, and advertising platforms are run by other companies, and they change how they work without asking us. We use methods we believe in and report honestly on what's happening, but we can't guarantee a ranking, a placement in an AI answer, a number of calls, or an amount of revenue, and we don't sell work on that basis. Anyone who guarantees you a first-page ranking is guessing.
Your responsibilities
You're responsible for the accuracy of what you ask us to publish, for having the right to use the content and images you give us, and for following the rules of your industry, such as licensing disclosures or advertising regulations. You agree to give us what we need to do the work on time, and to keep your accounts and passwords secure.
Limits
Our total liability to you for anything connected to our work or this site is limited to the amount you've paid us in the 12 months before the claim. We aren't liable for lost profits, lost data, or indirect damages, and neither of us is liable for delays caused by things outside our control. Some states don't allow every limit here, so some may not apply to you.
The legal part
These terms and any client plan are governed by the laws of the State of Georgia, and any dispute will be handled in the courts of Lowndes County, Georgia, unless we both agree to something else. If a part of these terms isn't enforceable, the rest still applies. If we change these terms, we'll update the date at the top of this page; changes apply to new plans and to existing plans at their next renewal.
